Introduction
By booking a photography session with Nadia Koles Photography, you confirm that you have read, understood, and agreed to these Terms & Conditions. These terms apply to all photography services unless otherwise agreed in writing. Specific details for your session, including deposit amount, final payment, and package contents, will be confirmed in your booking confirmation email.
Privacy Notice
We are committed to protecting your privacy in line with the UK Data Protection Act 2018 and the UK GDPR.
- Your personal data will only be used to arrange and deliver your photography service.
- We do not share your data with third parties unless required by law.
- Data is stored securely and deleted once it is no longer needed.
- You may request access, correction, or deletion of your personal data at any time by emailing nadiakolesphoto@gmail.com
By booking a session, you consent to this Privacy Notice.
Booking & Payment
Deposits: A non-refundable deposit is required to secure your booking. Deposit amounts vary depending on the type of session.
Final Payment: The remaining balance is due according to the session type:
- Mini-sessions: due on the day of the session.
- Family sessions: due at least 2 weeks before the session date.
- Weddings: due at least 4 weeks before the wedding date.
Travel Fees: Travel fees may apply for locations outside Wirral and Liverpool Central.
Late Payment: Non-payment may result in cancellation or rescheduling of your booking.
Cancellations & Rescheduling
Client Cancellations: Deposits are non-refundable. If you need to cancel or reschedule, please contact us as soon as possible.
Photographer Cancellations: In rare cases, we may need to cancel a session. All payments will either be refunded or the session rescheduled at a mutually convenient time.
Force Majeure: We are not liable for failure to perform due to events beyond our control, including illness, accidents, severe weather, or other unforeseen circumstances.
Image Use & Copyright
Images are protected under the Copyright, Designs and Patents Act 1988. Any unauthorized copying, distribution, or use is prohibited.
Copyright: All images remain the copyright of Nadia Koles Photography.
You are granted a personal licence to use edited images for private, non-commercial purposes.
Images must not be altered, sold, or entered into competitions without prior written consent.
Promotional Use: Images and/or video captured during your photoshoot may be used by Nadia Koles Photography for promotion on the website, social media, portfolio, marketing materials, or competitions unless you notify us in writing before the session at nadiakolesphoto@gmail.com
The photographer retains artistic license regarding poses, locations, lighting, and composition.
RAW and unedited images are not provided or available for purchase.
Editing & Delivery
The editing process is subject to the photographer's final say.
All images are carefully edited in the photographer’s artistic style. Minor retouching requests may be accepted once free of charge; further edits may incur an additional fee.
Rush orders are managed at the desecration of the photographer.
Approximate delivery timelines vary by session type:
- Mini-sessions: ~2 weeks
- Family sessions: ~4 weeks
- Weddings: ~8–12 weeks
Delivery may include online galleries, USB drives, and/or prints depending on the package.
While every effort is made to maintain colour accuracy, display devices and print processes may cause minor variations.
You are not permitted to filter or further edit any images.
Client Responsibilities
Please arrive on time. Late arrivals may reduce session time.
The photographer will not tolerate verbally or physically abusive behaviour.
Conduct yourself and your guests respectfully. Disruptive behaviour may result in early termination of the session without refund.
A parent or guardian must be present with minors at all times during the session.
Clients are responsible for their own belongings during the session; we are not responsible for lost items.
Liability
Our liability is limited to the total fees paid for the session.
We are not liable for indirect, incidental, or consequential loss (e.g., missed opportunities, emotional distress, or lost earnings).
Every reasonable care is taken with photographic materials; in the unlikely event of total photographic failure, liability shall be limited to a full refund of payments made.
We are not liable for image loss caused by unforeseen equipment failure, theft, fire, or data corruption, but every effort will be made to recover or re-shoot where possible.
Complaints
Any concerns should be raised in writing within 14 days of receiving your gallery.
We will review and respond to all complaints within 14 days.
If unresolved, disputes may be referred to mediation or other recognised resolution services in the UK.
Agreement
By paying a deposit and booking a session, you acknowledge and agree to these Terms & Conditions.
